Terms of Service
1. Agreement to These Terms
These Terms of Service ("Terms") govern your use of the website at tempohouse.com.vn (the "Site") and any reservation, event booking, ticket purchase, or enquiry you make through it, as well as your visit to our physical venue (together, the "Services"), operated by TEMPO House ("we", "us", "our"), a specialty café, cocktail bar, art gallery, and events space in Ho Chi Minh City, Vietnam.

By using the Site or the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services. For details on how we handle personal data, see our Privacy Policy, which is incorporated into these Terms by reference.
2. Eligibility
Age requirement: Our venue serves alcohol. You must be at least 18 years old to make a reservation, book an event, purchase a ticket, or be served alcohol on our premises, in accordance with Vietnamese law. We may request identification and may refuse service to anyone unable to provide it.
Authority to contract: By using the Services, you confirm that you have the legal capacity to enter into a binding contract under Vietnamese law.
3. Use of the Website
You agree to use the Site only for lawful purposes. You agree not to:
- Provide false, inaccurate, or misleading information when making a reservation, booking, or enquiry;
- Attempt to gain unauthorised access to the Site, our systems, or any account not your own;
- Use automated means (bots, scrapers) to access or extract data from the Site without our written permission;
- Interfere with or disrupt the Site's operation, security, or availability;
- Use the Site to transmit spam, malware, or unlawful content;
- Impersonate any person or entity, or misrepresent your affiliation with TEMPO House.
We may suspend or terminate your access to the Site, and decline current or future bookings, if we reasonably believe you have violated these Terms.
4. Reservations and Table Bookings
Subject to availability: Submitting a reservation request does not guarantee a table until we confirm it by email, phone, or WhatsApp.
Grace period: We hold reserved tables for a reasonable grace period after the booked time. Beyond that, we may release the table to walk-in guests.
Changes and cancellations: Please notify us as early as possible if you need to change or cancel a reservation, using the contact details in your confirmation. Repeated no-shows may result in us declining future reservation requests.
Group size: For large groups, we may require a deposit or pre-order — this will be communicated to you at the time of booking.
5. Event Bookings, Tickets, and Private Functions
Ticketed events: Where an event listed on the Site requires payment to attend, your registration is confirmed only once payment is successfully processed. You will receive a confirmation by email.
Private functions and corporate events: Bookings for private hire, corporate events, or custom functions are governed by the specific quote, proposal, or contract issued to you for that event, which takes precedence over these Terms for any conflicting term. Deposits, payment schedules, and cancellation terms for private functions are set out in that document.
Capacity and event changes: We may, where necessary, adjust an event's format, lineup, timing, or venue area, or cancel an event (e.g. due to insufficient registrations, force majeure, or circumstances beyond our reasonable control). Where we cancel a paid event, you will be offered a refund or credit as described in Section 6.
6. Payments and Refunds

We do not store your full card number or bank credentials — payment details are handled directly by our payment processors. All prices on the Site are stated in Vietnamese Dong (VND) unless otherwise indicated and are inclusive of applicable taxes unless stated otherwise.
Refunds and cancellations: Where a specific event, ticket, or booking has its own stated cancellation and refund policy (shown at the time of booking or in your confirmation), that policy applies. Where no specific policy is stated, refund requests are considered case by case — contact us at info@tempohouse.com.vn as soon as possible. Approved refunds are returned to the original payment method and may take several business days to appear, depending on your bank or payment provider.
Failed or disputed payments: If a payment fails, is reversed, or is successfully disputed with your bank or card issuer after we have provided the Services, we may seek to recover the amount owed and may decline future bookings from you.
7. Reviews, Photos, and User-Generated Content
If you post a review, photo, comment, or tag us on social media (including Facebook, Instagram, or TikTok), you grant TEMPO House a non-exclusive, royalty-free, worldwide licence to reshare, repost, or reference that content (with attribution to you where practicable) for promotional purposes on our own website and social media channels.
You are solely responsible for content you post and confirm you have the right to share it. We may remove content that is unlawful, defamatory, or violates these Terms, at our discretion.
8. Intellectual Property
The Site, including its design, text, graphics, photography, logos, and the TEMPO House name and branding, is owned by or licensed to TEMPO House and is protected under Vietnam's Law on Intellectual Property No. 50/2005/QH11 (as amended) and applicable international treaties. You may view and share pages of the Site for personal, non-commercial purposes. You may not reproduce, modify, distribute, or create derivative works from our content for commercial purposes without our prior written consent.
9. Third-Party Platforms and Services
The Site integrates with, links to, or otherwise relies on a number of third-party platforms to operate. We are not responsible for the content, availability, security practices, or terms of these third-party services, which are governed by their own respective terms:

Details on how these integrations use personal data are set out in our Privacy Policy. Your use of any linked third-party platform (for example, following us on Instagram or messaging us on WhatsApp) is subject to that platform's own terms of service and privacy policy, not ours.
10. Disclaimers
The Site and its content are provided "as is" and "as available." While we make reasonable efforts to keep information on the Site (including event listings, availability, and pricing) accurate and up to date, we do not warrant that the Site will be uninterrupted, error-free, or entirely secure, and we do not guarantee the accuracy of every listing at every moment.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Vietnamese law, including liability for death or personal injury caused by our negligence, or liability for fraud.
11. Limitation of Liability
To the fullest extent permitted by Vietnamese law, TEMPO House shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or the Services, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Services shall not exceed the amount you paid to us for the specific booking or transaction giving rise to the claim.
12. Indemnification
You agree to indemnify and hold TEMPO House harmless from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
13. Termination and Right to Refuse Service
We may refuse entry, service, or a booking to anyone, at our discretion, including for reasons of safety, capacity, dress code, intoxication, or disruptive behaviour, in accordance with our standard venue policies. We may also suspend or terminate your access to the Site at any time for violation of these Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Vietnam, including the Civil Code No. 91/2015/QH13, the Commercial Law No. 36/2005/QH11, and the Law on Protection of Consumers' Rights No. 19/2023/QH15. Any dispute arising from these Terms or the Services shall first be resolved through good-faith negotiation. If unresolved, the dispute shall be submitted to the competent courts of Ho Chi Minh City, Vietnam, unless otherwise required by mandatory consumer-protection law.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, technology, or legal requirements. Material changes will be communicated via the Site. The "Last updated" date at the top of this document reflects the most recent revision. Continued use of the Site or the Services following a material update constitutes acceptance of the revised Terms.
